Customer Affidavit

  • I am at least eighteen (18) years of age (or the age of majority in your jurisdiction), and I meet any additional age requirements applicable to specific products purchased.
  • My purchase and possession of the ordered products comply with all applicable local, state, and federal laws.
  • I will use all products in accordance with the manufacturer's instructions and applicable safety guidelines.
  • I agree not to export products in violation of applicable U.S. export laws.

Agreement to Indemnify and Defend

You agree to indemnify, defend, and hold harmless Arm or Ally S, LLC, and its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms and Conditions; (b) any misrepresentation made by you; (c) your misuse, storage, handling, or transportation of any product purchased from Arm or Ally S, LLC; or (d) your violation of any applicable law or regulation.

Release of Liability and Warranty Disclaimer

Arm or Ally S, LLC is a retailer and not a manufacturer. The products we sell are designed, manufactured, and tested by third parties. To the fullest extent permitted by applicable law, Arm or Ally S, LLC disclaims all warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose. Arm or Ally S, LLC is not responsible for damages resulting from improper use, installation, modification, storage, or handling of any product. Manufacturers provide critical safety and use information that you are responsible for reviewing before purchase and use.

Product Use Responsibility

By placing an order, you accept full responsibility for the use, storage, handling, and transportation of the product by yourself or any third party. Arm or Ally S, LLC shall not be liable for injuries, damages, or losses arising from the use or misuse of any product, to the extent permitted by applicable law.

Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or relating to these Terms or any purchase made through Armorally.com shall be brought exclusively in the state or federal courts located in Clay County, Missouri. To the fullest extent permitted by law, you consent to personal jurisdiction and venue in such courts, and any action filed elsewhere shall, to the fullest extent permitted by law, be dismissed or transferred accordingly..

Governing Law

All interactions with Armorally.com, including purchases and the receipt of information, as well as any legal actions arising from these interactions, are governed by the laws of Missouri.

Class Action Waiver

You agree that any dispute or claim against Arm or Ally S, LLC must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. You knowingly and voluntarily waive any right to participate in such actions.

Email Communications

By creating an account or placing an order on Armorally.com, you authorize Arm or Ally S, LLC to send transactional emails related to your purchase and, where permitted by applicable law, promotional communications. Your information will be handled in accordance with our Privacy Policy. You may unsubscribe from promotional emails at any time using the unsubscribe link provided.

Arm or Ally S, LLC does not control, endorse, or assume responsibility for the content, accuracy, privacy practices, or policies of any third-party sites, even if affiliated with us. Accessing any third-party site is done at your own risk.

Pricing and Information Disclaimer

Pricing and product information are subject to change without notice due to market conditions, product availability, or manufacturer changes. While we strive to provide accurate and current information, Arm or Ally S, LLC does not warrant the accuracy or completeness of content on this site. If a product is listed at an incorrect price or with incorrect information, Arm or Ally S, LLC reserves the right to refuse or cancel any order placed for that product, whether or not the order has been confirmed or payment has been processed. In the event of cancellation after payment, a full refund will be issued.

Ally Rewards Program

Program Overview

The Ally Rewards Program (“Program”) is a promotional rewards program operated by Arm or Ally S, LLC (“Company”). Participation in the Program is voluntary and available only to eligible consumer account holders. The Program is promotional in nature and does not constitute a stored-value account, gift certificate, property right, or a vested contractual benefit. Points have no cash value, are not transferable, and may not be exchanged for cash. The Company reserves the right, in its sole discretion, to modify, suspend, or terminate the Program at any time, with or without notice.

Eligibility

Participation is limited to individual consumer accounts. Business accounts and B2B purchasers are not eligible. Customers must create and maintain an active account to participate. Only one account per individual is permitted. The Company reserves the right to refuse, suspend, or terminate accounts or Program participation at its sole discretion, including, but not limited to, situations involving suspected fraud, abuse, duplicate accounts, manipulation of the Program, chargebacks, or violations of Company policies.

Earning Points

Eligible participants earn five (5) points for each one dollar ($1.00) spent on eligible product subtotal amounts. Points are calculated based on the post-discount product subtotal only. Points are not earned on taxes, shipping charges, fees, or excluded products. Certain products may be excluded from earning points or may earn points at different rates at the Company’s sole discretion. Points are issued only after an order has been completed and shipped. Points are not earned on purchases made using redeemed points. The maximum number of points that may be earned on a single order is 9,000 points. The Company reserves the right to adjust point balances to correct errors, including pricing, technical, or system malfunctions.

Point Value and Redemption

Two thousand (2,000) points are redeemable for five dollars ($5.00) in promotional store credit. Points may be redeemed in increments of 2,500 points, up to a maximum of 7,500 points per redemption. Redemption generates a promotional coupon code valid for thirty (30) days from issuance. Only one coupon may be applied per order. Redeemed coupons may not be combined with other coupon codes or military discount promotions. Coupons may be applied to orders that otherwise qualify for automatic promotions, such as sale pricing or non-coupon-based free shipping. Expired coupons are forfeited and will not be reinstated except at the Company’s sole discretion. The Company reserves the right to modify the point-to-dollar conversion rate, redemption thresholds, or other Program mechanics at any time.

Expiration

Points expire three hundred sixty-five (365) days from the date earned. Expired points are permanently forfeited and will not be reinstated except at the Company’s sole discretion. The Company may provide reminder notifications prior to expiration; however, failure to receive or review such notifications does not extend expiration dates.

Refunds, Chargebacks, and Adjustments

If an order is refunded in whole or in part, the corresponding points associated with that purchase will be reversed. If a chargeback is filed, the Company may immediately reverse associated points and suspend the account pending resolution. The Company reserves the right to terminate participation in the Program for chargebacks, suspected fraud, or abuse. The Company may adjust point balances at its sole discretion to correct errors or address misuse of the Program.

Account Suspension and Termination

The Company reserves the right, in its sole discretion, to suspend, restrict, or terminate accounts or Program participation at any time for any reason, including but not limited to fraud, abuse, policy violations, duplicate accounts, manipulation attempts, or chargebacks. Upon termination of an account or Program participation, all accumulated points may be forfeited.

Program Modifications

The Company reserves the right, at any time and in its sole discretion, to modify or discontinue the Program; change point earning rates; change point redemption rates; modify expiration policies; modify eligibility requirements; exclude products from earning; or adjust minimum or maximum redemption amounts. No modification, suspension, or termination of the Program shall give rise to any claim for compensation or damages.

Limitation of Liability

The Company is not responsible for technical errors, system outages, unauthorized account access, or other issues beyond its reasonable control affecting the earning or redemption of points. All determinations regarding the Program, including eligibility, point issuance, reversals, and redemptions, are made at the Company’s sole discretion and are final.

Store Policies 

Shipping Information

  • Signature confirmation is optional for orders under $500 and may be selected during checkout. Orders totaling $500 or more require signature confirmation and shipping insurance and will not ship without these protections.

  • Where signature confirmation is available, and the customer declines it, delivery confirmation by the carrier shall constitute completion of delivery, and responsibility for the shipment transfers upon such confirmation, except where prohibited by applicable law.

  • Carrier delivery times are estimates only. All carrier service guarantees have been suspended, and Arm or Ally S, LLC does not guarantee delivery times. Shipping charges are not refundable due to carrier delays, including delays affecting express services.

  • Saturday Delivery is not included in checkout shipping rates. Customers requesting Saturday delivery must contact support@armorally.com and may incur additional fees.

  • Customers are responsible for providing accurate shipping and contact information at checkout. Errors in email or address information may prevent delivery updates or successful delivery.

  • Delivery addresses cannot be changed once a shipment is in transit. Requests for address intercepts may be accommodated where possible and are subject to carrier fees and additional shipping costs, which are the customer’s responsibility.

  • Arm or Ally S, LLC is not responsible for failed deliveries resulting from incorrect or incomplete address information or lack of delivery access. Packages returned to the sender for these reasons are subject to return shipping and reshipment costs.

  • Free shipping promotions do not apply to Alaska. Orders shipped to Alaska may incur additional shipping charges, which will be communicated prior to shipment.

  • If shipping charges are not correctly calculated at checkout, Arm or Ally S, LLC reserves the right to hold or cancel the order until the balance is paid.

Shipping Insurance

  • All USPS Priority, UPS, and FedEx shipments include up to $100 of carrier-provided liability.

  • Optional Full-Value Insurance (FVI) may be available at checkout for eligible orders to increase coverage beyond the carrier’s standard liability. Orders totaling $500 or more ship with mandatory Full-Value Insurance (FVI) and signature confirmation.

  • FVI covers confirmed loss or damage occurring while the package is in the carrier’s possession. Coverage terminates upon the carrier's delivery confirmation.

  • If Full-Value Insurance is declined, where optional, reimbursement for confirmed loss or damage is limited to the carrier’s standard liability of $100.

  • Insurance coverage does not extend to theft or loss occurring after confirmed delivery.

Return Information

  • We offer a 30-day return policy. Returns must be initiated through the Customer Help Center and may require prior authorization.

  • Returned items must be unused, uninstalled, and in original condition with original packaging. Approved returns are subject to a 15% restocking fee and are not eligible for a refund of original shipping charges.

  • Items with opened or damaged packaging may be accepted at our discretion and may be subject to a 50% restocking fee. Damaged, blemished, used, or pre-fit items are not eligible for return.

  • Claims regarding blemished products must be made within 72 hours of delivery, as confirmed by the carrier. Manufacturer defects must be addressed directly with the manufacturer, though Arm or Ally S, LLC may, at its discretion, assist with contact information or facilitation.

  • Return shipping costs are the customer’s responsibility. Returned items must be shipped with full-value insurance. Arm or Ally S, LLC is not responsible for returns lost or damaged in transit.

  • Return abuse is not tolerated. Suspected abuse may result in denial of future returns, account restrictions, reporting to payment processors or credit bureaus, or referral to law enforcement where appropriate.

Returns or cancellations of promotional items.

Promotional offers associated with an order, including free shipping or discount coupons, are void if the qualifying item is returned or the order is canceled. If a promotional benefit has already been used, its value may be deducted from any refund issued.

Cancellation Policy

  • Orders may be canceled by submitting a cancellation request through the Customer Help Center. A cancellation fee equal to 10% of the order total, including applicable shipping and taxes, applies.

  • Orders are processed and shipped promptly. Cancellation requests are not guaranteed once processing has begun. Orders that ship prior to cancellation approval are subject to the return policy.

Price Adjustment Policy (Retroactive)

Price adjustments may be requested within two (2) days of purchase for differences exceeding $5. Approved adjustments are issued as in-store credit valid for 30 days. Arm or Ally S, LLC reserves the right to deny adjustment requests.

Claims Information

  • Claims for damaged, lost, or incorrect items must be submitted through the Customer Help Center within 72 hours of delivery confirmation. All packaging materials must be retained pending claim resolution.

  • Claims for manufacturer defects must be made directly with the manufacturer, though Arm or Ally S, LLC may assist with contact information.

  • No claims for missing packages will be honored when the carrier provides delivery confirmation. Theft after confirmed delivery is not covered.

Chargeback Fraud

Fraudulent chargebacks or disputed charges may result in an administrative fee up to $35, account restrictions, and liability for reasonable costs incurred in resolving the dispute. Submission of payment constitutes the cardholder's authorization.

Ammunition Purchases

The following policy applies to all ammunition sales on www.armorally.com.  The following advisement is conspicuously placed on all ammunition product pages.

  • You represent that you are legally eligible to purchase and possess ammunition under all applicable local, state, and federal laws.
  • You represent that you are at least eighteen (18) years of age, and at least twenty-one (21) years of age where required by law based on the type of ammunition purchased.
  • All ammunition sales are final.  No returns are permitted.
  • Ammunition orders must ship to a physical address and may not be shipped to P.O. Boxes.
  • Armorally.com may require an adult signature confirmation for delivery of ammunition orders.
  • Armorally.com may require verification of age and identity before shipping ammunition orders. If requested verification is not provided within a reasonable time, the order may be canceled and subject to applicable cancellation fees.

Armorally.com reserves the right to refuse or cancel any ammunition order where compliance with applicable law cannot be reasonably verified.

Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Arm or Ally S, LLC regarding use of the website and any purchases made through Armorally.com and supersede all prior or contemporaneous communications, representations, or agreements.
